Mississippi Pedestrian Collisions
Pedestrian accidents happen at an alarming rate in the United States. Each year, over 6,000 people lose their lives in pedestrian crashes in the United States. This is equal to about 17 per day. In Mississippi, over 100 people lose their lives per year due to pedestrian accidents. These wrecks happen for a multitude of different reasons, however, the main reason is driver negligence.
Regardless of the way a fatality takes place, only specific surviving family members of the victim are able to successfully bring a Mississippi wrongful death claim. These members of the victim’s family include:
- Siblings
- Parents
- Children
- Spouses
- A personal representative of the estate
Wrongful death claims are most often filed by the deceased victim’s spouse. If the couple has children, then any monetary compensation will be awarded to them and split evenly between surviving spouse and children.
The claimants in wrongful death cases can secure economic recoveries for two specific types of damages in Mississippi. These damages are:
- Economic damages: Compensatory damages are designed to compensate relatives of the victim for quantifiable and calculable damages. These may include medical bills acquired before the victim’s passing, funeral care costs, burial/cremation bills, lost earnings, and personal property damage.
- Non-economic damages: Also compensatory damages, non-economic damages are designed to compensate for the victim and their family’s intangible losses, such as pain, suffering, embarrassment, emotional trauma, etc. These types of damages are more difficult to put a price on but deserve to be compensated for nonetheless.
The total amount of financial compensation ultimately received by surviving family members usually varies depending on the circumstances of the claim itself.
